1) In consideration of being allowed to participate in the fitness activities and weight-loss programs and to use its facilities, equipment, machinery and mats, subject only to statutory rights and implied warranties which cannot be excluded, I do hereby waive, release and forever discharge Serenity Fitness, LLC owners and employees from any and all responsibilities or liabilities from injuries or damages arising out of or connected with my attendance and/or participation in all fitness and weight-loss activities, my use of equipment and/or machinery, passive, or active, any omission or commission, including any liability arising from the negligence of Serenity Fitness, LLC owners and employees.

2) I understand and I am aware that strength training, flexibility and aerobic exercise, including the use of equipment, machinery and mats are potentially hazardous activities. I also understand that fitness activities and weight-loss programs involve a risk of injury and even death. If I engage in any type of exercise and/or weight-loss programs at the Serenity Fitness, LLC facility, I acknowledge that I am voluntarily participating in these activities and using equipment and machinery with knowledge of the dangers involved. Subject only to the statutory rights and implied warranties which cannot be excluded, I hereby agree to expressly assume and accept any and all risks of injury or death in respect of myself and caused directly by me or as a result of my conduct, omissions or negligence to others. I hereby further agree to expressly assume all responsibility for any injury or death caused directly or indirectly through my conduct, omissions or negligence to any third party (including Serenity Fitness, LLC owners and employees) through my attendance at Serenity Fitness, LLC.

3) I do hereby further declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity, or other illness that would prevent my participation in any Serenity Fitness, LLC workout, including the use of equipment, machinery and mats and/or my participation in any weight-loss programs at Serenity Fitness, LLC. I do hereby acknowledge that I have been informed of the need for a medical practitioner’s approval for my participation in any exercise activity, in the use of exercise equipment, machinery and mats and if applicable, in the participation of any weight-loss program. I also acknowledge that it has been recommended that I have a yearly or more frequent physical examination and/or consultation with my physician as to physical activity, exercise, use of exercise and training equipment and participation of any weight-loss program offered at Serenity Fitness, LLC so that I might have his/her recommendations concerning these fitness activities, equipment use and/or weight-loss programs. I acknowledge that I have either had a physical examination and have been given my medical practitioner’s permission to participate, or that I have decided to participate in the fitness activities, use of equipment, machinery and mats, and/or weight-loss programs without the approval of my physician and do hereby assume, subject only to the statutory rights and implied warranties which cannot be excluded, all responsibility for my participation in the physical activities, exercise, use of equipment, machinery and mats, and/or participation of any weight-loss program at Serenity Fitness, LLC. I do hereby acknowledge that, unless expressly informed otherwise, Serenity Fitness, LLC owners and employees are not medical experts or practitioners, and I do not rely on them for medical advice or decisions.

Member agrees to purchase the use of Sellers’ facilities for specified amount of time. An exception will be allowed to put Member’s membership on hold without any penalty in the event Member provides Seller with a doctor’s notice of physical inability to continue facility use. In the event of Member’s death, Member’s estate may cancel this membership by notifying Seller at the address herein.

BUYERS RIGHT TO CANCEL

You may cancel this transaction within three business days from the above date. 

If you cancel, any payments made by you under the contract, less twenty dollars, and any negotiable instrument executed by you will be returned within forty-five (45) days following receipt by the seller of your cancellation notice and any security interest arising out of the transaction will be canceled. After you cancel, the physical exercise club may request the return of all contracts, membership cards, and other documents or evidence of membership.

By my signature below, I acknowledge that I have received a copy of the physical exercise rules of Seller’s facility, including the hours of operation. 

By my signature below, I, the Member, certify that I am physically able to use all facilities and do hereby agree that this facility is not responsible or liable to me for any injury, accident or loss of personal property. I understand that I cannot transfer this membership to any other person. I do hereby release this facilities owners and employees from any claim or cause of action which may have occurred as a result of any medical problem known or unknown of which I have knowledge presently or in the future. I verify no promises or guarantees, other than those written in this agreement, were made to me by this facility or its employees. I agree to follow Serenity Fitness, LLC instructional guidelines and to cooperatively utilize the facilities with other members. Failure to do so may result in cancellation of my membership. I CERTIFY THAT I HAVE READ THIS AGREEMENT AND AGREE TO THE TERMS HEREIN.

TALENT AGREEMENT & RELEASE

FO R GOOD AND VALUABLE CONSIDERATION, Talent agrees as follows:

1. Use of Name and Likeness . (a) Talent hereby grants to Serenity Fitness, LLC and its parent, subsidiaries, affiliates, successors, and assigns (collectively hereinafter referred to as “Serenity Fitness, LLC”) the absolute right and permission to use in perpetuity Talent’s name, likeness, photograph(s), video or film footage, biography, testimonial and/or voice, either alone or accompanied by other material, take by Serenity Fitness, LLC, in any manner and in any media, including social media (i.e. Facebook), throughout the world, at any time, for the purpose of advertising and publicizing Serenity Fitness, LLC’s products or services and for any other lawful purpose. The results and proceeds of Talent’s services shall be considered “works made for hire.” Talent waives all rights to inspect and approve the finished product, its use or such written or spoken copy as may be used in connection therewith. 

(b) Talent acknowledges that any pictures, statements, or voice or film recordings taken of Talent by Serenity Fitness, LLC and any pictures, statements, or film or audio footage submitted by Talent are or will become the sole property of Serenity Fitness, LLC. If Talent receives any print, negative, or other copy thereof, Talent shall not make use of it or authorize its use by anyone else. 

(c) Talent releases Serenity Fitness, LLC and its assignees, licensees, designees, successors, officers, employees, and agents, and all other persons/entities involved in the use, production, exhibition, or distribution of Talent’s name, likeness, photograph(s), video or film footage, biography, testimonial and/or voice, in accordance with the terms hereof, from any and all claims, damages, liabilities, costs, expenses and causes of action for any violation of any personal and proprietary right Talent may have in connection with the exhibition, distribution, or other use of the works made for hire, including without limitation any claims or causes of action with respect to invasion of privacy, trespass, right to publicity, and defamation, including what might be deemed to be misrepresentation of Talent, Talent’s character, or Talent’s person due to distortion, optical illusion, or faulty reproduction that may occur in the finished product. 

(d) Nothing in this Agreement will constitute any obligation on the part of Serenity Fitness, LLC to make any use of any of the rights granted by Talent under this Agreement. 

2. No Conflicts or Competition . Talent warrants and represents that this Agreement does not in any way conflict with any existing commitment. Talent will not authorize or permit the use of Talent’s name, voice, photograph, and/or likeness or testimonial in connection with the advertising or promotion of any product or service competitive to or incompatible with Serenity Fitness, LLC’s products or services for one year after the date of this Agreement. 

3. Independent Contractor . Talent acknowledges that he/she is an independent contractor of Serenity Fitness, LLC and is not an employee, partner, joint venture, or agent for any purpose. Talent does not have any authority to bind Serenity Fitness, LLC in any respect. Talent will be solely responsible for any payment, if applicable, of any taxes associated with compensation paid to Talent by Serenity Fitness, LLC. 

4. Miscellaneous . There are no other agreements, representations, or warranties not set forth herein with respect to the subject matter hereof; and the parties expressly acknowledge that any representation, promise or inducement by any party to any other party that is not embodied in this Agreement is not part of this Agreement, and they agree that no party shall be bound by or liable for such alleged representation, promise, or inducement not set forth herein. 

I, Talent, have read this Agreement, fully understand its terms and understand that I am giving up certain rights. I acknowledge that I am signing the Agreement freely and voluntarily and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law. I certify that I am of legal age and sound mind and have the full right and power to enter into this Agreement.

Welcome to Serenity Fitness, LLC!! 

CONGRATULATIONS ON TAKING THE INITIATIVE IN MAKING SERENITY FITNESS, LLC PART OF YOUR HEALTHY LIFESTYLE! 

● To achieve your health and fitness goals, we recommend working out 3 to 4 times per week. You will be AMAZED at your improvement! Members must workout in a manner consistent with the teachings and philosophies of Serenity Fitness, LLC.
● Clean enclosed-toed shoes are required for use on the equipment! Please dedicate a separate pair of clean, dry workout shoes that you carry in with you or leave here for your workout.
● You will need to work hard and fast enough on the equipment to overload your muscles. If you do not put in the effort, you will not receive the results. The equipment will help you build muscle. Every
pound of muscle you build will burn 50 more calories a day at rest than one pound of fat.
● Join us for the traditional workouts, scheduled classes (ex. Zumba or Yoga – may require an additional fee for the instructor). Please see the class calendar for class times and fees if you wish to participate.
● Childcare is not available on the premises, yet there is a children’s corner if your child is able to
entertain themselves. Please reserve this me to focus on you and your health.

● Monthly coaching sessions will be provided throughout the month. We provide this service to our
members to help them achieve their fitness goals. Whether to improve balance, flexibility, answer
questions, weight management or measurements.

HOURS OF OPERATION: 

Temporary Holds Due to Medical Reasons/Summer/Travel  

Our hold policy is temporary and a membership can be placed on hold with a doctor’s note or verbal communication for up to 60 days. The membership will be put on hold for a specified amount of time (30 or 60 days) and will be reinstated when that me has expired. It is the member’s responsibility to be in contact with us if the hold needs to be extended. 

Cancellation

1. Medical cancellation: Membership may be immediately canceled with a doctor’s written statement if the member is permanently unable to exercise at our facility. 

2. Member cancellation: A membership can be canceled at any me with a 30 day written notification. A Serenity Fitness, LLC Membership Amendment Form will need to be filled out and signed. A copy will remain on file and be given to the member for their records. 

Returned Checks/Auto Pay

A $30.00 fee for non-sufficient funds or returned checks will be charged for insufficient checks or auto pay denial. 

Snow or bad Weather Policy

Serenity Fitness, LLC. Will adapt the schedule if travel is not advised because of snow or icy conditions. If weather is questionable please call 563-382-4709 or visit our Facebook page before venturing out. We will close as needed for the safety of our members and employees.
